When the interaction of multiple actors (vehicle manufacturers, equipment manufacturers, telecommunication operators, road infrastructure operators, etc.) is required, as is the case for cooperative systems and automated driving, liability issues can be a barrier to the deployment of ITS applications and services.
On behalf of the European Commission (ITS Action Plan 5.2), Rapp, together with a law firm, analysed the current legal situation in several EU member states and the USA. Based on the results of a stakeholder survey and discussions at a stakeholder meeting, the requirements of the stakeholders were collected and recommendations for the European Commission were derived.
